ANAF will monitor the road transport of goods with high fiscal risk, according to GEO no. 41/2022 from 11.04.2022, and the sanctions for non-compliance with the obligations are drastic. According to GEO no. 41/2022, the RO e-Transport System is established through which ANAF will monotorize the road transport of goods with high fiscal risk. The system becomes mandatory from July 1st, 2022 (for some products and obligators) and involves the implementation of software necessary to fulfill the obligations of declaration in the system.
The E-transport system includes information modules for the management of the transport of goods through which the data regarding the sender and the beneficiary are recorded, the name, characteristics, quantities and counter value of the transported goods, the places of loading and unloading, details on the means of transport used, the ITU code generated.
Failure to comply with the proceeds on the doorstep by GEO no. 41/2022 is sanctioned with drastic fines, from 10,000 lei to 50,000 lei in the case of individuals and from 20,000 lei to 100,000 lei in the case of legal entities.
In addition, ANAF has announced they can also order the confiscation of the value of undeclared assets, and in some cases, the deeds can cross into the criminogenic zone.
