Measures against the unauthorized production and sale of electronic fiscal devices, equipment, and software are proposed in Serbia

The Government of the Republic of Serbia has recently proposed amendments to various financial and tax laws, including one notable proposal for a new provision to the Law on Tax Procedure and Tax Administration. Specifically, the Government has proposed that persons who unauthorizedly manufacture or sell electronic fiscal devices, equipment, and software, without first registering them in the manufacturer's register of electronic fiscal devices, may face a prison sentence ranging from one to five years. This comes as a form of punishment for anyone looking to avoid the recording of retail transactions using illegal fiscal hardware or software.

Additionally, the responsible individual in the legal company will also be prohibited from engaging in business activities for a period of one to five years as a security measure, and their electronic devices, equipment, and software will be confiscated.

This news represents a strengthening of the earlier sanctions, which were mostly financial in nature. If this proposal is approved, it will take effect eight days after it is published in the Official Gazette of the Republic of Serbia.
