The draft law abolishing the obligation to record sales does not count on the continued operation of the EET system on the part of the Financial Administration from January 1, 2023, even for voluntarily registering entrepreneurs. The Financial Administration warns taxpayers that, as of January 1, 2023, the recording of realized sales through cash registers will, with a high probability, be completely impossible.

The timetable for the end of EET operations is dependent on the legislative process of the draft law approved by the Chamber of Deputies, which repeals Act No. 112/2016 Coll., as amended, on the registration of sales and amends and repeals other related legal regulations.

In the event that the EET system ceases to operate, the cashier will no longer establish a connection with the EET system. In practice, there may be situations similar to an internet connection failure when a receipt containing the PKP code (taxpayer signature code) instead of the FIK code (fiscal identification code) is issued to cash registers. The cash register will repeatedly try to send data about the registered sales via a data message, but the cash register will no longer receive the confirmation message from the EET system due to the system being turned off.

If the cash register has a function that allows you to "turn off" the recording of sales, we recommend turning off this function on the cash register so that it no longer connects to the EET system. However, individual cash registers may react differently to the shutdown of the EET system by the Financial Administration. In the event that technical problems arise in connection with the termination of the EET system, it is advisable to discuss the resulting situation with the supplier of the specific cash register equipment.
