The Ministry of Finance has recently put up for public debate a new Draft Order amending the procedure for technical approval of models of fiscal electronic cash registers. In the context of the changes that occurred at the level of the Methodological Norms, the analysis of the functioning of unsupervised equipment such as commercial vending machines (vending machines) resulted in the need to amend and complete the previous Order for reasons such as the following ones.
The entire set of vending machines consists of payment peripherals and the control unit, which may function differently depending on the protocols used by them, which is why it is necessary to submit technical documentation that includes the type of protocol used by the vending machine as well as the types of protocols used by payment peripherals.
In order to have a clear record regarding the configuration of commercial vending machines, when requesting the issuance of technical approval, the economic operator will submit the technical documentation of the protocol and payment peripherals used in testing or production. Any configuration other than the one declared in the documentation and which is not tested in an environment similar to the production one will not be recognized by the approval committee as complying with the specific legislation in force.
Since vending machines operate with different protocols, and under these conditions the data and data structure may be different, if the economic operator requests the testing of an electronic fiscal cash register that can be used with more than one protocol, this machine will be subjected to separate testing for each protocol. If the fiscal electronic cash register subject to approval is equipped with several communication ports specific to protocols, but the economic operator does not want to test them, ICI Bucharest will apply a seal to the witnessed equipment subjected to approval in order to identify the port or ports on which its operation is not allowed.
Additionally, it should be noted that the authorities have recently established, through another normative act, that the authorization for the distribution of cash registers (inclusive of those for vending machines, i.e., unattended equipment) can also be issued to companies in electronic format.
The amendment draft, along with the details on what will be amended and when it will be enforced, is yet uncertain; however, some details will need to be adjusted based on the specifics of this kind of equipment, as it is said by the authorities of this country.
