Important obligation for restaurant business in catering in Bulgaria in 2024
Summary
At the end of 2023, a large number of regulations and laws will have passed all procedures and been finally accepted. One of them is a law amending the tax and insurance procedural codes. This regulation introduces a new obligation: the persons performing restaurant business in catering and entertainment establishments (bars, restaurants, clubs, cafes, fast food, etc.) with categories of two, three, four, or five stars must also provide the possibility of payment through a POS terminal device. Therefore, they are obliged to provide EFT terminals to their customers if they want to pay via bank credit or debit card. Also, these subjects are obliged to place information on the possibility of payment through a POS terminal device in a place visible to customers in the establishments. This obligation will begin on March 1, 2024.

Importantly, fines are also predefined for not respecting the above-mentioned rules. Moreover, for natural persons who are not traders, in the amount of BGN 100 to 500, or with a pecuniary sanction, for legal entities and sole traders, in the amount of BGN 500 to BGN 2,000. In the case of repeated violations, from BGN 1,000 to BGN 4,000. Also, for not making visible information about these new obligations, you will be fined: for individuals who are not traders, in the amount of BGN 100 to BGN 300, or a pecuniary sanction for legal entities and sole traders, in the amount of BGN 300 to BGN 1,000. In cases of repeated violations, the fine is from BGN 200 to BGN 600, and the property sanction is from BGN 600 to BGN 2,000.
