Brazil Updates e-Invoicing Rules for State VAT/Federal VAT Taxpayers Without State Registration
Brazil’s Technical Note 2026.007 updates NF-e model 55 for IBS/CBS, allowing eligible non-ICMS taxpayers to issue invoices without an issuer IE. Systems must apply new validation and SVRS routing rules. Testing starts Sept. 1, 2026, with production from Nov. 3, 2026; the IE exemption applies only in defined cases.
Brazil has published Technical Note 2026.007, introducing changes to the electronic invoice model 55 as part of the implementation of the new State VAT (IBS) and Federal VAT (CBS) tax system.
The main change allows certain businesses that are exclusively subject to State VAT and Federal VAT and are not VAT (ICMS) taxpayers to issue an e-Invoice without providing the issuer’s State Registration number (IE). Previously, the IE field was mandatory, but under the new rules its occurrence becomes optional in the relevant scenarios.
This change is intended to support businesses that may need to issue e-Invoice documents under the new tax system even though they do not have an VAT (ICMS) State Registration. This could include, for example, companies mainly providing services that need to issue e-Invoices for certain transactions involving goods or fixed assets.
However, simply omitting the State Registration number will not automatically qualify a business for this treatment. The authorization system will check that the company’s tax identification number (CNPJ) is active with the Federal Revenue Service and that the establishment does not have an active VAT (ICMS) State Registration in the relevant state.
e-Invoice model 55 documents issued under this new scenario without an IE will be authorized through the Virtual Tax Authority of Rio Grande do Sul (SVRS). Several validation rules are therefore being adjusted to allow SVRS to authorize these invoices even when the issuing state differs from the state of the authorization environment.
Technical Note 2026.007 also removes some existing rejection rules. In particular, the rejection related to a missing issuer IE will be removed for all authorization environments, meaning that the absence of the State Registration number will no longer automatically cause an e-Invoice to be rejected. The validation rule concerning a recipient CNPJ not being registered is also being removed.
At the same time, Brazil will expand the use of federal and state taxpayer databases, including the Centralized List of RFB Taxpayers (LCC-RFB) and Centralized Taxpayer Registry (CCC), when validating information contained in e-Invoice documents. These databases will be used to check details such as the issuer and recipient CNPJ, registration status and information related to pickup and delivery locations.
For businesses and software providers, the main impact is that invoicing systems must no longer treat the issuer’s IE as mandatory in every situation. Systems will need to determine when the IE is required and when an e-Invoice can legally be issued without it, as well as correctly route the relevant invoices to SVRS.
The change does not mean that the IE field can generally be removed from e-Invoice documents. The exemption applies only to the specific situations established by Technical Note 2026.007.
The new rules are scheduled to become available for testing on September 1, 2026, with production implementation planned for November 3, 2026. Businesses affected by the change should use the testing period to update their NF-e systems and validation rules.
