TAX-FREE is a VAT refund system for foreigners who do not have their permanent place of residence in the territory of the EU. Currently, there is a paper circulation of documents and receipts. A stamp is required that confirms that the goods are being exported outside the EU. From January 1, 2022, all taxpayers in the VAT refund system will be required to issue TAX-FREE documents in electronic form. The new system should be operative from 1st January 2022.

From July 1, 2021, entrepreneurs will be able to register at PUESC so that they can adapt to the new regulations. Poland will be the next country in the EU to introduce its electronic TAX-FREE system. 

The condition for such a sale would be not only registration in the system, but also the installation of an online cash register. If entrepreneurs do not meet these conditions, they will not be able to sell in the electronic Tax-Free system. Such requirements result from the amendment of the so-called SLIM VAT (from the English words: simple, local, and modern).

This tool will be made available in the form of an e-service on the Platform for Electronic Tax and Customs Services (PUESC).

Both entrepreneurs and foreign buyers will benefit from the new solution. The new solution will provide entrepreneurs with quick and easy access to data about transactions carried out in the TAX-FREE system and will facilitate settlements with buyers and the tax administration

TAX-FREE is a VAT refund that refers to:

  • traveler who has purchased goods in Poland above PLN 200,
  • received a receipt from the cash register,
  • took the goods intact outside the territory of the EU and obtained confirmation from an officer of the Customs and Tax Service.

Changes in the TAX-FREE system were initiated in November 2020 with an amendment to the Act on Value Added Tax. Two acts which are in the consultation phase, which covers the TAX-FREE system are:

Regulation of the Minister of Finance, Funds, and Regional Policy on the records kept in the TAX-FREE system.

Regulation of the Minister of Finance, Funds and Regional Policy on the model of the sign informing travelers about the possibility of purchasing goods for which VAT refund is due, the stamp of the customs authority confirming the export of goods outside the European Union, and the data contained in the TAX-FREE electronic document and its printout.
