. Among other things, the draft of the new law established the following:
- The working hours of sales facilities are independently determined by the trader for the period from Monday to Saturday, for a total duration of up to 90 hours per week.
- Sales facilities are to be closed on Sundays and public holidays, with the fact that the FBiH Government can determine which sales facilities are obliged to operate during holidays and to what extent.
There are certain exemptions envisioned, and based on those, the previous two provision rules would not apply to:
- Florists, bakeries, souvenir shops, objects of traditional and old crafts, as well as sales objects that are part of railway and bus stations and airports, gas stations, hospitals, hotels, areas of cultural and religious objects, museums and nature parks, cemeteries, and specialized stores related to sales at cemeteries;
- Drugstores, whose working hours are from 00:00 to 24 hours every day;
- Purchase of primary agricultural products; sale of own agricultural products at stands, tables, and boxes at retail markets;
- Sale of own agricultural products at stands, tables, and boxes outside retail markets;
- Sales organized as part of fairs, events, and exhibitions;
- Sales through online stores, selling through vending machines, and selling in the production facilities of family farms.
The Government of FBiH has indicated that the highlighted two provisions will not be applied even during the declaration of a natural disaster or a state of emergency when the working hours of sales, warehouses, and office facilities are determined by the Federal Administration of Civil Protection (FUCZ). They announced that this law will also regulate online sales as well.
The draft of the new law on internal trade is about to be considered by the FBiH Parliament in the upcoming weeks and, thus, not yet accepted as the final regulation. If parliamentarians accept this draft law, there will be a public debate on the draft law, after which the complete text will be finally determined. If parliamentarians adopt the articles of the draft law, then it can be applied in practice based on the deadline yet to be defined as a deadline for the implementation of such a law.
