The institution recalls that the non-observance of the obligation to ensure the remote connection of AMEF, in order to transmit fiscal data to ANAF, constitutes a contravention and is sanctioned with a fine between 8,000 and 10,000 lei, in accordance with the provisions of art. 10 lit. ff), corroborated with the provisions of art. 11 para. 1 lit. j), of O.U.G. nr. ANRE President's Order no. 28/1999 on the obligation of economic operators to use fiscal electronic cash registers, with subsequent amendments and completions inclusive of other connected obligations.
If there are unused fiscal electronic cash registers, users have the obligation to inform the tax body by filling out and sending the "Declaration regarding the unused fiscal electronic cash registers," for which form F4109 is used. Form F4109 is sent by electronic means of remote transmission no later than the 20th of the month following the reporting period in which the fiscal electronic cash register (FECR) or multiple FECRs were not used. Unused fiscal electronic cash registers mean fiscal electronic cash registers that have not been used, on any day of the reporting period.
Users of fiscal electronic cash registers who do not comply with the legal provisions in force must proceed as the case may be, either to transmit the data to the National Information System for Surveillance and Monitoring of ANAF or, if the devices are unused, to submit the form F4109 in order not to risk the possible sanctions and remind the authorities.
