Agency for Digital Italy (AGID) defined new requirements for creating and preserving the E-documents, which will be applicable from the 7th June 2021.
The AGID is the institution that is responsible for drawing up and defining the digital environment structure, through defining the guidelines and technical rules with the legal force.
One of the responsibilities of the institution is to define and establish technical rules for the creation, management, preservation, and storage of the e-documents.
Working under compliance with the AGID specifications the business entities are presumed that are operating under the legal obligations defining the e-document operations.
The new technical guidelines define the most important elements for an electronic document.
The two most important elements concerning electronic documents are the creation and preservation of the e-document.
The legal provisions covering this field state that the e-document is created when it can no longer be changed.
The e-documents can be created in different manners, depending on the solution used for its creation. There are various tools used to structure the document like the one which will remain unchangeable, to maintain its integrity. Those tools are between others, electronic seal or signature. The next mandatory requirement is to connect each issued document with the metadata report.
The second obligatory requirement which AGID uses to define the validity of the e-document is the preservation of the e-document. Preservation is explained as the procedure which is handled before the document is stored. The document before it will be stored is hashed, signed, and timestamped.
On the other side, another important public institution that regulates the digitization environment in Italy, ADE (Agency for digitization) has implemented one additional and different requirement in comparison with AGID rules that is the search criteria. Searching of the specific document for the e-document store in the preservation system.
Full compliance concerning transactions that involve usage of the E-documents are obtained if an e-invoice is in coherence with both technical/legal specifications issued by the AGID and ADE institutions.
